Executive Summary

This document sets out the binding policies governing Booking Fees for Nusantara Craft Academy:

• Non-Refundable Fee: All Booking Fees are strictly non-refundable once payment is confirmed.
• Non-Transferability: Booking Fees cannot be transferred to another person, Programme, or intake.
• Cancellation & No-Show: Any cancellation, withdrawal, or failure to attend results in full forfeiture of the Booking Fee.
• Rescheduling by Academy: If the Academy reschedules or amends a Programme, the Booking Fee will be transferred to a new intake or arrangement. No cash refund will be provided unless approved at the Academy’s sole discretion.

Participants are strongly advised to review these Terms & Conditions in full prior to making payment.

1. Definitions

For the purposes of these Terms & Conditions:

• Academy means Nusantara Craft Academy.
• Booking Fee means the fee paid by a Participant to secure a place in a Programme, which is strictly non-refundable, non-transferable, and non-exchangeable.
• Programme means any training course, workshop, or educational offering conducted by the Academy.
• Participant means the individual who registers for and/or attends a Programme.

2. Core Booking Fee Policies

• Non-Refundable Fee: All Booking Fees are strictly non-refundable once payment is confirmed.
• Non-Transferability: Booking Fees cannot be transferred to another person, Programme, or intake.
• Cancellation Forfeiture: Any cancellation, withdrawal, or failure to attend results in full forfeiture of the Booking Fee.
• Rescheduling Policy: If the Academy reschedules or amends a Programme, the Booking Fee will be transferred to a new intake or arrangement. No cash refund will be provided unless approved at the Academy’s sole discretion.

3. Non-Refundable Booking Fee

All Booking Fees paid to the Academy are strictly non-refundable, non-transferable, and non-exchangeable once payment has been received and the booking confirmed.

Under no circumstances shall the Booking Fee be refunded, whether in whole or in part, except at the sole and absolute discretion of the Academy.

4. Purpose of the Booking Fee

The Booking Fee secures the Participant’s placement in a Programme with limited enrolment capacity. Upon confirmation, the Academy commits resources and incurs administrative, operational, and logistical costs, including:

• Reservation of a training seat, preventing allocation to other Participants.
• Registration, enrolment, verification, and administrative processing.
• Preparation and allocation of:
  • Training manuals
  • Practical materials
  • Tools and consumables
  • Certificates and learning resources
• Scheduling and allocation of:
  • Trainers
  • Assessors
  • Facilitators
  • Supporting personnel
• Reservation and preparation of:
  • Classrooms
  • Laboratories
  • Equipment and facilities
• Procurement and preparation of course materials and supplies.
• Operational planning, coordination, and logistical arrangements prior to Programme commencement.

The Booking Fee constitutes consideration for these commitments and is not a deposit for future services.

5. Non-Transferability of Booking Fee

The Booking Fee is personal to the registered Participant and may not be:

• Transferred or assigned to another individual;
• Applied to another Programme, intake, or training date; or
• Converted into credit for future courses.

Any exception must be expressly approved in writing by the Academy and shall be granted only in exceptional circumstances at the Academy’s sole discretion.

6. Participant Cancellation, Withdrawal & No-Show

If a Participant withdraws, cancels, fails to attend, or is unable to participate for any reason—including personal, medical, employment, travel, financial, or unforeseen circumstances—the Booking Fee shall be forfeited in full.

No refund, replacement, credit, or compensation will be provided.

Participants who fail to attend without prior written approval from the Academy will be deemed to have forfeited their booking. In such cases:

• No refund will be issued;
• No rescheduling will be permitted; and
• No replacement or credit will be granted.

7. Academy’s Right to Amend, Postpone, or Reschedule

The Academy reserves the right, at its sole discretion, to:

• Amend Programme details;
• Postpone or reschedule sessions;
• Relocate venues; or
• Cancel Programmes.

Such actions may arise due to, but are not limited to:

• Insufficient enrolment;
• Trainer unavailability;
• Operational requirements;
• Safety considerations; or
• Force majeure or circumstances beyond reasonable control.

In such cases:

• The Booking Fee shall remain valid and be transferred to the next available intake or alternative arrangement;
• No cash refund will be provided unless approved at the Academy’s sole discretion; and
• The Academy shall not be liable for any additional Participant costs, including travel, accommodation, or personal expenses.

8. Limitation of Liability

To the fullest extent permitted by applicable law, the Academy shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the Programme or these Terms & Conditions.

This includes, without limitation:

• Loss of income;
• Travel expenses;
• Accommodation costs; and
• Personal or incidental losses.

9. Force Majeure

The Academy shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to:

• Natural disasters;
• Pandemics;
• Government actions or restrictions;
• Acts of war;
• Civil unrest; or
• Other force majeure events.

In such circumstances, the Academy may reschedule the Programme or make alternative arrangements without any obligation to refund the Booking Fee.

10. Acceptance of Terms

By making payment of the Booking Fee, the Participant confirms that they have read, understood, and agreed to be legally bound by these Terms & Conditions.

The Participant acknowledges that the Booking Fee constitutes consideration for the reservation of a training place and for the administrative and operational commitments undertaken by the Academy.

11. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the Academy operates.

Any dispute arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

12. Entire Agreement

These Terms & Conditions constitute the entire agreement between the Academy and the Participant in relation to the Booking Fee and supersede all prior agreements, representations, or understandings, whether written or oral.

13. Severability

If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

14. Amendments

The Academy reserves the right to amend, update, or revise these Terms & Conditions at any time. Any such amendments shall take effect upon publication or notification by the Academy. Continued participation or payment by the Participant shall constitute acceptance of the revised Terms & Conditions.
